Settlement Compensation Pending
Settlement Approved in Northstar TCE Class Action
CAMBRIDGE - The Northstar TCE Class Action was approved yesterday by the Honourable Justice Perell of the Ontario Superior Court. The Class Action had been brought on behalf of Cambridge residents against Northstar Aerospace, Inc. and Northstar Aerospace (Canada) Inc. in respect of alleged contamination of Trichloroethylene ("TCE") in the proximity of Northstar's Bishop Street plant.
"We are very pleased with this result and look forward to moving ahead with the implementation of the compensation program" says Michael Eizenga, one of the Class Counsel responsible for negotiating the settlement. David Thompson, another of the Class Counsel, indicated that formal notice of the settlement would be published in the near future and would provide details, including deadlines, of how claimants are able to submit a claim.
Assuming the settlement is implemented as envisioned, Class Members will receive their first payment under the program in November. The plaintiff class in this action is represented by a consortium of three area firms:
- David Thompson from Scarfone Hawkins LLP
- Neena Gupta from Gowling Lafleur Henderson LLP
- Mike Eizenga and Matthew Baer from Siskinds LLP
